New Orleans police have issued an arrest warrant for Nate Diaz on suspicion of second-degree assault after a brawl on Bourbon Street went viral.

NOPD spokeswoman Karen A. Boudrie confirmed the allegations to MMA Fighting Monday night, but could not provide further details about the arrest warrant. “A warrant has been issued — he is not in custody,” Budri said. A representative for Diaz declined to comment when contacted by MMA Fighting.

The state police filed the charges after collecting video of the incident, in which Diaz allegedly choked an unconscious Rodney Peterson-like Logan Paul during a brawl that overflowed from a bar, Budry said. Peterson later revealed a serious head injury and vowed revenge on Diaz, who was backing teammate Chris Avila at Misfits Boxing 6 in New Orleans.

Bourbon Street Police were called to stop a major fight, Boudrie said. In the video, an officer can be seen trying to defuse the fight that erupted from the bar, but fails to notice a blond man – identified as Peterson – as he collapses unconscious on the concrete.

The NOPD later released a statement about the altercation and the charges against Diaz.

“Saturday April 22 at approximately 2:10am – NOPDs Bourbon Street. Boardwalk staff and supervisors have been alerted that a significant altercation has occurred in the 400 block of Bourbon Street,” the statement said. “Officers were able to disperse the crowd. A witness alerted officers to a white male subject who was believed to be unconscious. Moments later, the subject regained consciousness. Officers determined the subject was bleeding from the back of the head and emergency services were called for help. Following an investigation, a warrant was issued for Nate Diaz. He was charged with second-rate battery. He is not currently in custody.”

Second-degree battery is a felony in Louisiana, punishable by up to eight years in prison “with or without hard labor,” a $2,000 fine, or both.

After the street brawl, Diaz threw a water bottle at Chase DeMoor, sparking another brawl in the arena of an influential boxing match, sparking a scuffle, security personnel intervened.

Diaz, 38, will face Jake Paul in an August fight in his first appearance since retiring from the UFC as a free agent.
